Just so you know

Use of the Washington State seal for other than state business or by written consent of the Secretary of State is a violation of state law. re: WAC 434-04-040

See the regs here

I really don't think anyone would consider this

an attempt at misrepresentation. Besides, it isn't the state seal.
»

Maybe not

misrepresentation but misappropriation probably. I have to disagree with the idea it's not the state seal. It's the state seal with slight alterations to suit what looks like a business use.

After reading the regs,

I don't think this use violates them. I think they changed the seal enough, and I don't believe the intent of the flier is to make people think the event is sponsored by the state.

Rather than continue to speculate

how about we just forward this to the SOS office and ask for an opinion? I'd be curious to know what they might think, no matter what side an opinion may fall on. Might be a good civics lesson for us all?

The SOS has a history of vigorously enforcing the state code on this question. The rare occurance usually happens in an election year when some not-so-bright legislator running for re-election uses the seal on a campaign web site or brochure. The SOS is known to act quickly when it learns of the use.

Yes. Let's get the SOS to

Yes. Let's get the SOS to bust the promoters and The Midnite Sun. Then the venue can't violate any noise ordinance, and everyone (except the minors) can go to the Le Voyeur show instead.

well

If it helps the argument, my two year old just saw this picture and said "there's the State seal!"

Well, pt. 2

I imagine your two-year-old is smarter than most of us put together anyway, right?I'm, um, 52 (ouch, it hurts to type that!) and I thought exactly the same thing on first sight. The rest of the message is lost to 'Ol George plunked down in the middle of things. Maybe that's the point. Hard to know what those artists are up to.

I'm not too sure this is an argument - at least I hope it's not - so much as my curiosity as a so-called citizen journalist coming forth.
